STRATEGI BERTUTUR ADVOKAT DALAM PERSIDANGAN PERKARA PIDANA DI EMPAT PENGADILAN NEGERI DI INDONESIA

Abstract

This research is motivated by the importance of speaking strategies for advocates in court. Advocates as legal advisors have a crucial role in providing direction and guidance in speaking strategies at trial. This study aims to describe how the strategy of  speaking advocates in criminal trials. This research is a quantitative type with a descriptive analysis method. The research was conducted by  exploring draft  exceptions in four regions in Indonesia. The data collection techniques are, (1) reading and understanding, (2) classified according to research indicators, (3) marking research indicators (4) recording and assessing data recording. Data analysis techniques, reduction, data presentation, and drawing conclusions. The validity of the data with proof is taken directly from the snippet of the execution draft. This is to detail specifically and measurably by conducting direct proof. The results of the study showed that  the most dominant speaking strategy for advocates was "the strategy of speaking frankly with small talk maintaining positive politeness". The least was "the strategy of speaking without any form of small talk".

Penelitian ini dilatarbelakangi pentingnya strategi bertutur bagi advokat di persidangan. Advokat sebagai penasihat hukum memiliki peranan yang krusial dalam memberikan arahan dan bimbingan dalam strategi bertutur di persidangan. Penelitian ini bertujuan mendeskripsikan bagaimana strategi bertutur advokat dalam persidangan pada perkara pidana. Penelitian ini jenis kuantitatif dengan metode deskriptif analisis. Penelitian dilakukan dengan studi mengeksplorasi draft eksepsi pada empat wilayah di Indonesia. Teknik pengumpulan data yaitu, (1) membaca dan memahami, (2) diklasifikasikan sesuai indikator penelitian, (3) menandai indikator penelitian (4) melakukan pencatatan dan penilaian pencatatan data. Teknik analisis data, reduksi, penyajian data, dan menarik kesimpulan. Pengabsahan data dengan pembuktian diambil langsung dari cuplikan draft eksepsi. Hal ini untuk untuk merinci secara spesifik dan terukur dengan cara melakukan pembuktian langsung. Hasil penelitian ternyata strategi bertutur advokat yang paling dominan adalah“strategi bertutur secara terus terang dengan basa-basi mempertahankan kesantunan positif” yang paling sedikit “strategi bertutur tanpa adanya bentuk basa-basi”.
